The following is the terms of the legal agreement concluded between you and www.tmatlantic.com ("TMA").

By accessing, browsing and/or using this site ("SITE"), you confirm that you have read, understood, and agree to be bound by these terms and to comply with all applicable laws and regulations, including the U.S. export and re-export control laws and regulations. If you do not agree to these terms do not use this Site.

Any claims relating to, and the use of, this Site and the materials contained herein is governed by the laws of the state of Florida.

Use Restrictions

The copyright in all the material provided on this Site is held by TMA or by the original creator of the material. Except as stated herein, none of the material may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise, without the prior written permission of TMA or the copyright owner. Any unauthorized use of any material contained on this Site may violate copyright laws, trademark and trade secret laws, the laws of privacy and publicity, and communications regulations and statutes.

Payment

We accept credit cards (Visa, MasterCard, AMEX, Discover, Diners Club, PayPal, Google CheckOut,) for payment. Our online security provides ordering with maximum security and privacy.(please veiw our SSL Certficate). Credit card orders are authorized on the day the order is received. Please see Privacy Policy.

Please Note: In accordance with our company policy all purchases where billing and shipping addresses don’t match must be verified by our representative. T&M Atlantic associate will contact you at the number provided during normal business hours.

Shipping

Shipping time and cost depend on the delivery address and shipping option you choose.

Orders are normally shipped within 5 business days. Express orders will be shipped within 3 business days. Shipping to the US locations are by UPS Ground or UPS 2nd Day Air mail. Shipping to other global destinations are by USPS Global International mail.

Exchange Policy

Exchanges will be accepted within 7 days on receipt.

Exchanges may be made for merchandise only.

The Buyer bears responsibility for the shipping of the merchandise to be exchanged.

We require that you e-mail for pre-approval prior to the return of merchandise for exchange.

The merchandise must be returned exactly as it was received, including the original packaging. Please enclose the copy either of your invoice or the copy of the order confirmation we e-mailed to you.

Return Policy

In accordance with the universal retail policy for special items, all sales are considered FINAL. However, we understand that online customers purchase under somewhat blind conditions. Thereby, we allow returns as follows.

  1. The return/exchange authorization number (REA#) should be obtained by filling the REA Form.
  2. Put the REA# on the outer side of the package as well as on the enclosed packing list noting for the return.
  3. Return postmark on the package within 3 business days on the merchandise receipt/delivery.
  4. A re-stocking/handling charge will be made of 15% of the goods sale value for goods which have been ordered in error.
  5. If the item was returned in a non-working condition, after use, additional 10% will be charged for diagnostics and assessment
  6. Exchanges are subject to the regular shipping and handling charges.

Please note that any problems with the merchandise or order must be reported immediately, and returns must be postmarked within the time limit as stated above.

All merchandise must be returned in its ORIGINAL CONDITION in its ORIGINAL PACKAGING. The company reserves the right to refuse or impose 15% restocking fees on all unauthorized, late, damaged, and/or items missing labels. Returns sent after the allowed period of time will be shipped back to the customer, and all costs incurred in returning the item will be charged by the customer.

A re-stocking/handling charge will be made of 15% of the goods sale value for goods which have been ordered in error.

Exchanges are subject to the regular shipping and handling charges.

No returns are allowed for wholesale orders, special orders and accessories.

Customizations, Modifications, Additions:
All devices sold by T&M Atlantic that have been modified, customized or had any features added and are marked with letter "L" or "S" in the model name are subject to 50% restocking fee. If the item you purchased is not functioning T&M Atlantic will repair or replace the items but will refund 50% of the purchase.

All software purchases are not refundable.

Shipping costs are not refundable.

Domestic Warranty Repair (Continental US)

If a customer discovered a problem with instrument purchased through T&M Atlantic the following conditions will apply:

  1. A customer must send their instrument to our service center and cover the cost of shipping

  2. After receiving the item our service technician will determine if the problem was caused by the instruments malfunction (in that case the repair will be covered by warranty) or by a customer’s misuse. It takes approximately 5 business days for our service technicians to determine the cause of problem.
  3. Once our technician has determined the cause of the problem the customer will be notified.
  4. If the problem was caused by the instrument malfunction we will repair the instrument under warranty free of charge to the customer. It takes approximately 10-20 business days to complete the repair depending on parts availability. After the repair the item will be shipped back to customer free of charge.
  5. If the problem was caused by customer’s misuse we will calculate the cost of repair and notify the customer. Customer will determine if they want to proceed with repair or to receive the item back, in both cases customer is responsible for the shipping costs.

International Warranty Repair (Includes Alaska and Hawaii)

If a customer discovered a problem with instrument purchased through T&M Atlantic the following conditions will apply:

  1. A customer must send their instrument to our service center and cover the cost of shipping

  2. Other Terms and Conditions

TMA is not responsible for typographical errors. TMA reserves the right to cancel any order you have placed if there was a typographical error on the TMA site concerning the pricing or availability of any item you ordered when you placed the order. TMA reserves the right to change the terms and conditions of sale at the TMA online store at any time.

TMA reserves the right to change any products or services information offered on the TMA Site, or on any prices for products or services, at any time, without notice.

TMA reserves the right to do any of the following, at any time, without notice:

1) to modify, suspend or terminate operation of or access to the TMA Site for any reason;

2) to modify or change the TMA Site and any applicable policies or terms;

3) to interrupt the operation of the TMA, or any portion of the TMA Site, as necessary to perform routine or non-routine maintenance, error correction, or other changes.

To the extent permitted by law all sales at TMA are governed by Florida law, without giving effect to its conflict of law provisions.

No TMA employee has the authority to vary any of the TMA Store's policies or the terms and conditions governing any sale.

If any of the aforementioned policies are held by a court or other tribunal of competent jurisdiction to be void or unenforceable, such policy shall be eliminated or limited to the minimum extent necessary and replaced with a valid provision that best embodies the intent of the policy, so that the policies shall remain in full force and effect.

These policies shall not be interpreted or construed to confer any rights or remedies on any third parties.
